When to Seek Arbitrage: As a client, you can initiate the Arbitrage process if you encounter any of the following situations during a SafePay Deal:

  1. Non-Acceptance of Work: The professional fails to complete the work without valid reasons or justification.
  2. Lack of Communication: The professional becomes unresponsive and fails to maintain open and effective communication.
  3. Breach of Agreements: Either party violates the agreed-upon terms and conditions of the project, such as scope, timeline, or payment terms.
  4. Unfulfilled Timeline: The project’s agreed-upon timeline has not been met, and there is no clear resolution in sight.
  5. Unsolved Issues: Any other situation that cannot be resolved through direct communication and negotiation between you and the professional.

Initiating Arbitrage: If the work on the project is not finished but stopped due to any circumstances, either you or the professional can click the “Discontinue” button in the Workspace to inform the other party and request Arbitrage’s intervention. This action changes the project’s status to “Disputed,” and both you and the professional will still have access to the workspace and project summary.

Arbitrage Decisions: The Arbitrage mediators have the authority to make the following decisions based on their evaluation of the dispute:

  1. 100% Return of Payment: If the final result is not delivered within the agreed-upon time or does not comply with the task requirements, the mediator may recommend a full refund to you.
  2. 100% Payment to the Professional: If the final result is fully completed according to the guidelines and submitted within the specified time, the mediator may rule in favor of the professional and recommend the full payment.
  3. Split Payment: In some cases, the mediator may suggest splitting the payment between you and the professional. This decision is typically made if the project is partially completed and delivered on time. Factors considered for payment splitting include equal or easily divided project parts or a prior agreement between both parties on how the budget will be allocated for different project components.

Arbitrage Cancellation: In certain situations, both you and the professional may agree to cancel the Arbitrage process. This can occur if a resolution is reached, or if you decide to continue working on the project without further mediation. Once Arbitrage is canceled, the project returns to the standard mode, and both parties resume their normal workflow. It’s essential to note that Arbitrage can be canceled and requested again an unlimited number of times until the project is closed.
